Compliance Plan
Existing Stationary Container Systems for which a compliance plan is in effect [Regulation 17.91 and Schedule 1 Clause 45, Health and Safety at Work (Hazardous Substances) Regulations 2017]

Classes 6 or 8
Locations where classes 6 or 8 substances are present [Regulation 13.38, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
Classes 2.1.1, 2.1.2 or 3.1
Locations where classes 2.1.1, 2.1.2 or 3.1 substances are present [Regulation 10.34, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The certification of locations where class 2.1.1 substances are present is limited to:
i. packages (cylinders) to a maximum aggregate quantity of 5,000 kg (liquefied gases) or 5,000 cubic meters (permanent gases); and
ii. above ground bulk storage to a maximum aggregate capacity of
15,000 L.

The certification of locations where class 3.1 substances are present is authorised for:
i. storage in packages in one or more AS 1940 cabinets to a maximum aggregate quantity of 2,000 L;
ii. storage in packages in a separate building or external storage area to a maximum aggregate quantity of 10,000 L;
iii. storage in packages with a maximum aggregate quantity of
2,000 L in a store in a building or a maximum aggregate quantity of 10,000 L in a type D store in a building as per regulation 11.31, Health and Safety at Work (Hazardous Substances) Regulations 2017;
iv. storage of packages in a retail store;
v. storage in stationary container systems at vehicle refuelling facilities; and
vi. use up to a maximum aggregate quantity of 4,000 L.
 
Classes 5.1.1 or 5.1.2
Locations where classes 5.1.1 or 5.1.2 substances are present [Regulation 12.17, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The certification of locations where classes 5.1.1 or 5.1.2 substances are present does not include substances stored in bulk storage tanks;

The certification of locations where class 5.1.2 substances are present is limited to a maximum aggregate capacity 1,500 kg (non-permanent gases) or 750 cubic meters (permanent gases).

Burning of Class 3.1 substances
Stationary Container Systems that include installations for burning class 3.1 substances [Regulation 17.91(2)(g), Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The authorisation for stationary container systems that include installations for burning class 3.1 substances is limited to a maximum tank capacity of 10,000 L.
 
Dispensers
Stationary container systems that include dispensers [Regulation 17.91(2)(m), Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
Installation
The installation of Stationary Container Systems [Regulation 17.91(2)(b), Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The authorisation for above ground stationary container systems is limited to tanks up to maximum capacity of 20,000 L per tank used or intended to be used to contain a hazardous liquid; or 40,000 L per tank used or intended to be used to contain diesel fuel or low flashpoint diesel.

The authorisation for below ground stationary container systems is limited to tanks with a maximum capacity of 100,000 L per tank used or intended to be used to contain a hazardous liquid.

The authorisation for stationary container systems does not include vapourisers [Regulation 17.91(2)(f), Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation does not include stationary container systems that include transfer line between ship and stationary tank [Regulation 17.91(2)(i)(iii), Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation for stationary container systems does not include the repair and alterations of above ground or below ground tanks [Regulation 17.91(2)(l), Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation for stationary container systems does not include a design that is to be certified as per regulation 17.93(1)(a) [Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation of stationary container systems does not include a fabricator for the purpose of constructing a stationary tank or process container in accordance with a design as per regulation 17.93(1)(b) [Health and Safety at Work (Hazardous Substances) Regulations 2017].

Conditions that apply for this authorisation

  • Mr McLellan must perform the functions of a compliance certifier in an objective manner that promotes safety.
  • Mr McLellan must remain a fit and proper person throughout the period of this authorisation.
