Authorisation as a compliance certifier is varied with effect from 19 August 2020 under regulation 6.20(1)(c) of the Health and Safety at Work (Hazardous Substances) Regulations 2017 on the grounds that Mr Alan Mountfort:

  • has failed to comply with the provisions in the Regulations requiring him to be satisfied that the relevant requirements are met before issuing location compliance certificates and tank wagon in service compliance certificates; and
  • has failed to perform the functions of a compliance certifier in an objective manner that promotes safety


The condition requiring Mr Alan Mountfort's to perform the functions of a compliance certifier in an objective manner that promotes safety has been varied to:

Mr Mountfort must perform the functions of a compliance certifier in an objective manner that promotes safety and, in particular, may not use any third party to carry out any inquiry, inspection, assessment, or examination necessary to satisfy himself that the relevant requirements for a Tank Wagon in Service compliance certificate or a Location compliance certificate have been met.

Mr Mountfort was suspended on 22 February 2019 for tank wagons (in service), while subject to an investigation into his performance as a compliance certifier. This suspension was lifted on 14 May 2019.

Mr Mountfort was suspended on 2 March 2020 for tank wagons (in service), while subject to an investigation into his performance as a compliance certifier. This suspension was lifted on 22 September 2020.

  • Mr Mountfort must remain a fit and proper person throughout the period of this authorisation.
