Compliance Plan
Existing Stationary Container Systems for which a compliance plan is in effect [Regulation 17.91 and Schedule 1 Clause 45, Health and Safety at Work (Hazardous Substances) Regulations 2017]

Classes 5.1.1 or 5.1.2
Locations where classes 5.1.1 or 5.1.2 substances are present [Regulation 12.17, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The certification of locations where class 5.1.1 substances are present is limited to:
i. storage in packages up to a maximum quantity of 50,000 kg;
ii. bulk storage up to a maximum capacity of 1,000 L per tank.

The certification of locations where class 5.1.2 substances are present is limited to cylinders in storage and in use up to a maximum aggregate quantity of 1,000 kg (non-permanent gases) or 2,000 cubic meters (permanent gases).
 
Class 5.2
Locations where class 5.2 substances are present [Regulation 12.42, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The certification of locations where class 5.2 substances are present is limited to organic peroxides in packaged goods only up to a maximum aggregate quantity of 250 kg.
 
Classes 6 or 8
Locations where classes 6 or 8 substances are present [Regulation 13.38, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
Classes 2.1.1, 2.1.2 or 3.1
Locations where classes 2.1.1, 2.1.2 or 3.1 substances are present [Regulation 10.34, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The certification of locations where class 2.1.1 substances are present is limited to:
i. packages (cylinders) to a maximum aggregate quantity of 10,000 kg (non-permanent and liquefied gases) or 10,000 cubic meters (permanent gases);
ii. storage in stationary container systems to a maximum quantity of 30,000 kg.

The certification of locations where class 3.1 substances are present is limited to:
i. storage in closed packages in one or more AS 1940 cabinets;
ii. storage in packages in a separate building or external storage area to a maximum aggregate quantity of 10,000 L;
iii. storage in closed packages with a maximum aggregate quantity of 10,000 L in a store in a building;
iv. use up to a maximum aggregate quantity of 2,500 L;
v. bulk storage up to a maximum aggregate quantity of 240,000 L for aqueous flammable mixtures used for refrigeration purposes; and
vi. bulk storage at vehicle refuelling facilities up to a maximum aggregate quantity of 120,000 L.

Burning of Class 3.1 substances
Stationary Container Systems that include installations for burning class 3.1 substances [Regulation 17.91(2)(g), Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The authorisation for stationary container systems that include installations for burning class 3.1 substances installed prior to 1 July 2006 (existing) or installed subsequent to 1 July 2006 which have previously been certified is limited to a maximum tank capacity of 60,000 L.
The authorisation for new stationary container systems connected to installations for burning class 3.1 substances is limited to a maximum above ground tank capacity of 40,000 L that have been designed certified and fabricated by an approved fabricator.
 
Burners
Stationary Container Systems that include burners [Regulation 17.91(2)(g) and (h), Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The authorisation for stationary container systems connected to burners installed prior to 1 July 2006 (existing) or installed subsequent to 1 July 2006 which have previously been certified is unlimited.
The authorisation for new stationary container systems connected to burners is limited to above ground tanks storing class 3.1 substances up to a maximum capacity of 40,000 L that have been designed certified and fabricated by an approved fabricator.
 
Installation
The installation of Stationary Container Systems [Regulation 17.91(2)(b), Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Conditions: The authorisation for stationary container systems is limited to tanks:
a) installed prior to 1 July 2006 (existing) or;
b) installed subsequent to 1 July 2006 which have previously been certified [Regulation 17.91(2)(b), Health and Safety at Work (Hazardous Substances) Regulations 2017] with the following maximum capacities:
i. above ground tanks up to a maximum capacity of 60,000 L per tank used or intended to be used to contain a hazardous liquid.
ii. below ground tanks with a maximum capacity of 60,000 L per tank used or intended to be used to contain a hazardous liquid.

The authorisation for stationary container systems includes new above ground tanks storing:
i. petrol up to a maximum capacity of 5,000 L that have been designed certified and fabricated by an approved fabricator.
ii. diesel up to a maximum capacity of 40,000 L that have been designed certified and fabricated by an approved fabricator.

The authorisation for stationary container systems does not include vapourisers [Regulation 17.91(2)(f), Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation does not include stationary container systems that include transfer line between ship and stationary tank [Regulation 17.91(2)(i)(iii), Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation for stationary container systems does not include the repair and alterations of above ground or below ground tanks [Regulation 17.91(2)(l), Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation for stationary container systems does not include a design that is to be certified as per regulation 17.93(1)(a) [Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation of stationary container systems does not include a fabricator for the purpose of constructing a stationary tank or process container in accordance with a design as per regulation 17.93(1)(b) [Health and Safety at Work (Hazardous Substances) Regulations 2017].

Conditions that apply for this authorisation

  • Mr McMath must perform the functions of a compliance certifier in an objective manner that promotes safety.
  • Mr McMath must remain a fit and proper person throughout the period of this authorisation.
