Compliance Plan
Existing Stationary Container Systems for which a compliance plan is in effect [Regulation 17.91 and Schedule 1 Clause 45, Health and Safety at Work (Hazardous Substances) Regulations 2017]
Conditions: The authorisation for stationary container systems (installation, with a dispenser and with a compliance plan) [Regulation 17.91(2)(b), Health and Safety at Work (Hazardous Substances) Regulations 2017] is limited to tanks at a vehicle refuelling facility that were:
a) installed prior to 1 July 2006 (existing) or;
b) installed subsequent to 1 July 2006 and that have previously been compliance certified,
and, in either case, with the following maximum capacities:
i. above ground tanks with a maximum capacity of 50,000 L per tank used or intended to be used to contain a class 3 hazardous liquid.
ii. below ground tanks with a maximum capacity of 50,000 L per tank used or intended to be used to contain a class 3 hazardous liquid.
The authorisation for stationary container systems does not include:
(i) stationary container systems with a vapourisers [Regulation 17.91(2)(f), Health and Safety at Work (Hazardous Substances) Regulations 2017];
(ii) installations for burning class 3.1 substances [Regulation 17.91(2)(g), Health and Safety at Work (Hazardous Substances) Regulations 2017];
(iii) stationary container systems connected to a burner [Regulation 17.91(2)(g) and (h), Health and Safety at Work (Hazardous Substances) Regulations 2017;
(iv) stationary container systems that include transfer line between ship and stationary tank [Regulation 17.91(2)(i)(iii), Health and Safety at Work (Hazardous Substances) Regulations 2017];
(v) a design that is to be certified as per regulation 17.93(1)(a) [Health and Safety at Work (Hazardous Substances) Regulations 2017];
(vi) the repair and alterations of above ground or below ground tanks [Regulation 17.91(2)(l), Health and Safety at Work (Hazardous Substances) Regulations 2017];
(vii) a fabricator for the purpose of constructing a stationary tank or process container in accordance with a design as per regulation 17.93(1)(b) [Health and Safety at Work (Hazardous Substances) Regulations 2017].

Conditions: The certification of locations where class 3.1 substances are present is limited to:
i. storage in closed packages in one or more AS 1940 cabinets to a maximum aggregate quantity of 1,000 L;
i. closed packages with a maximum aggregate quantity of 2,000 L in a store in a building or a maximum aggregate quantity of 10,000 L in a type D store in a building as per regulation 11.31, Health and Safety at Work (Hazardous Substances) Regulations 2017;
ii. closed packages with a maximum aggregate quantity of 10,000 L for storage in Type A, B, C and D building;
iii. use up to a maximum aggregate quantity of 2,500 L; and
iv. bulk storage up to a maximum quantity of 120,000 L.

Conditions: The certification of locations where class 2.1.1 (A and B) substances are present is limited to:

ii. above ground bulk storage to a maximum aggregate quantity of 4 tonne of liquid petroleum gas (LPG)

Installation
The installation of Stationary Container Systems [Regulation 17.91(2)(b), Health and Safety at Work (Hazardous Substances) Regulations 2017]

Conditions that apply for this authorisation
- Mr Taylor must perform the functions of a compliance certifier in an objective manner that promotes safety.
- Mr Taylor must remain a fit and proper person throughout the period of his authorisation.
