Existing Stationary Container Systems for which a compliance plan is in effect [Regulation 17.91 and Schedule 1 Clause 45, Health and Safety at Work (Hazardous Substances) Regulations 2017]
Class 3.1
Locations where class 3.1 substances are present [Regulation 10.34, Health and Safety at Work (Hazardous Substances) Regulations 2017]
Conditions: The certification of locations where class 3.1 substances are present is authorised for:
i. storage in closed packages in one or more cabinets to a maximum aggregate quantity of 1,000 L;
ii. storage in packages in a separate building or external storage area to a maximum aggregate quantity of 5,000 L;
iii. bulk storage at previously certified vehicle refuelling facilities up to a maximum aggregate quantity of 250,000 L.
i. storage in closed packages in one or more cabinets to a maximum aggregate quantity of 1,000 L;
ii. storage in packages in a separate building or external storage area to a maximum aggregate quantity of 5,000 L;
iii. bulk storage at previously certified vehicle refuelling facilities up to a maximum aggregate quantity of 250,000 L.
Class 2.1.1
Locations where class 2.1.1 substances are present [Regulation 10.34, Health and Safety at Work (Hazardous Substances) Regulations 2017]
Conditions: The certification of locations where class 2.1.1 substances are present is authorised for:
i. packages (cylinders) to a maximum aggregate quantity of 1,000 kg (liquefied gases) or 1,000 cubic meters (permanent gases);
ii. storage in stationary container systems to a maximum quantity of 5,000 L.
i. packages (cylinders) to a maximum aggregate quantity of 1,000 kg (liquefied gases) or 1,000 cubic meters (permanent gases);
ii. storage in stationary container systems to a maximum quantity of 5,000 L.
Installation
The installation of Stationary Container Systems [Regulation 17.91(2)(b), Health and Safety at Work (Hazardous Substances) Regulations 2017]
Conditions: The authorisation for stationary container systems (installation, burners, burning of class 3.1 substances, transfer point pipework, dispensers and compliance plan) [Regulation 17.91(2)(b), Health and Safety at Work (Hazardous Substances) Regulations 2017] is limited to above and below ground tanks that were:
a) installed prior to 1 July 2006 (existing) which have previously been certified or;
b) installed subsequent to 1 July 2006 which have previously been certified,
and, in either case, with the following maximum capacities:
i. above ground tanks with a maximum capacity of 1,000,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance; or
ii. below ground tanks with a maximum capacity of 250,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance.
The authorisation for stationary container systems does not include:
i. stationary container systems with vapourisers [Regulation 17.91(2)(f), Health and Safety at Work (Hazardous Substances) Regulations 2017].
ii. the repair and alterations of above ground or below ground tanks [Regulation 17.91(2)(l), Health and Safety at Work (Hazardous Substances) Regulations 2017].
iii. a design that is to be certified as per regulation 17.93(1)(a) [Health and Safety at Work (Hazardous Substances) Regulations 2017].
iv. a fabricator for the purpose of constructing a stationary tank or process container in accordance with a design as per regulation 17.93(1)(b) [Health and Safety at Work (Hazardous Substances) Regulations 2017].
a) installed prior to 1 July 2006 (existing) which have previously been certified or;
b) installed subsequent to 1 July 2006 which have previously been certified,
and, in either case, with the following maximum capacities:
i. above ground tanks with a maximum capacity of 1,000,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance; or
ii. below ground tanks with a maximum capacity of 250,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance.
The authorisation for stationary container systems does not include:
i. stationary container systems with vapourisers [Regulation 17.91(2)(f), Health and Safety at Work (Hazardous Substances) Regulations 2017].
ii. the repair and alterations of above ground or below ground tanks [Regulation 17.91(2)(l), Health and Safety at Work (Hazardous Substances) Regulations 2017].
iii. a design that is to be certified as per regulation 17.93(1)(a) [Health and Safety at Work (Hazardous Substances) Regulations 2017].

Transfer Point pipework

Conditions that apply for this authorisation
- Mr Cumming’s inquiry, inspection, assessment or examination of any stationary container systems with each tank greater than 250,000 L in capacity for the purposes of compliance certification must be peer reviewed by an authorised compliance certifier before the issuance of a compliance certificate. This peer review must be recorded in writing by the compliance certifier who undertakes the review and must confirm compliance with Part 17 of the Regulations for the issuance of a compliance certificate.
- Mr Cumming must perform the functions of a compliance certifier in an objective manner that promotes safety.
- Mr Cumming must remain a fit and proper person throughout the period of this authorisation.
- This authorisation ends on the earlier of the following: a. 5 years after the date on which the authorisation was granted; or b. When the authorisation holder ceases to be an employee of Worley New Zealand Limited.
