Installation

Scope: The authorisation for the installation of stationary container systems is limited to tanks:
a) installed prior to 1 July 2006 (existing) which have previously been certified or;
b) installed subsequent to 1 July 2006 which have previously been certified;
and, in either case, with the following maximum capacities:
i. above ground tanks with a maximum capacity of 1,000,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance; or
ii. below ground tanks with a maximum capacity of 250,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance.

The authorisation for stationary container systems does not include:
i. stationary container systems with vapourisers [Regulation 17.91(2)(f), Health and Safety at Work (Hazardous Substances) Regulations 2017].
ii. the repair and alterations of above ground or below ground tanks [Regulation 17.91(2)(l), Health and Safety at Work (Hazardous Substances) Regulations 2017].
iii. a design that is to be certified as per regulation 17.93(1)(a) [Health and Safety at Work (Hazardous Substances) Regulations 2017].
iv. a fabricator for the purpose of constructing a stationary tank or process container in accordance with a design as per regulation 17.93(1)(b) [Health and Safety at Work (Hazardous Substances) Regulations 2017].

Stationary tanks – Design, Construction and Installation
The design, construction and installation of stationary tanks [Regulation 17.91(2)(b), Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Scope: The authorisation is for the installation of stationary tanks as per regulation 17.91(2)(b)(iii) and is limited to tanks:
a) installed prior to 1 July 2006 (existing) which have previously been certified or;
b) installed subsequent to 1 July 2006 which have previously been certified;
and, in either case, with the following maximum capacities:
i. above ground tanks with a maximum capacity of 1,000,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance; or
ii. below ground tanks with a maximum capacity of 250,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance.

The authorisation for stationary tanks does not include a design that is to be certified as per regulation 17.91(2)(b)(i) [Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation for stationary tanks does not include the construction of a tank that is to be certified as per regulation 17.91(2)(b)(ii) [Health and Safety at Work (Hazardous Substances) Regulations 2017].

Compliance Plan
Existing Stationary Container Systems for which a compliance plan is in effect [Regulation 17.91 and Schedule 1 Clause 45, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Scope: The authorisation for the installation of stationary container systems is limited to tanks:
a) installe d prior to 1 July 2006 (existing) which have previously been certified or;
b) installed subsequent to 1 July 2006 which have previously been certified;
and, in either case, with the following maximum capacities:
i. above ground tanks with a maximum capacity of 1,000,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance; or
ii. below ground tanks with a maximum capacity of 250,000 L per tank used or intended to be used to contain a class 3.1 hazardous substance.

Class 2.1.1
Locations where class 2.1.1 substances are present [Regulation 10.34, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Scope: The certification of locations where class 2.1.1 substances are present is authorised for:
i. packages (cylinders) to a maximum aggregate quantity of 1,000 kg (liquefied gases) or 1,000 cubic meters (permanent gases);
ii. storage in stationary container systems to a maximum quantity of 5,000 L.
 
Class 3.1
Locations where class 3.1 substances are present [Regulation 10.34, Health and Safety at Work (Hazardous Substances) Regulations 2017]
 
 
Scope: The certification of locations where class 3.1 substances are present is authorised for:
i. storage in closed packages in one or more cabinets to a maximum aggregate quantity of 1,000 L;
ii. storage in packages in a separate building or external storage area to a maximum aggregate quantity of 5,000 L;
iii. storage in previously certified stationary container systems up to a maximum aggregate quantity of 250,000 L.

Conditions that apply for this authorisation

  • Mr Cumming’s inquiry, inspection, assessment or examination of any stationary container systems with each tank greater than 250,000 L in capacity for the purposes of compliance certification must be peer reviewed by an authorised compliance certifier before the issuance of a compliance certificate. This peer review must be recorded in writing by the compliance certifier who undertakes the review and must confirm compliance with Part 17 of the Regulations for the issuance of a compliance certificate.
