Ms Dianne Stockdale’s authorisation as a compliance certifier was varied with effect from 14 October 2019 under regulation 6.20(1)(c) of the Health and Safety at Work (Hazardous Substances) Regulations 2017 on the grounds that Ms Stockdale has failed to perform the functions of a compliance certifier in an objective manner that promotes safety by not adequately supervising or assessing the work of third parties that she engaged.
This variation added the following condition to Ms Stockdale’s authorisation:
Ms Dianne Stockdale must not use any third party in any capacity in respect of the inquiry, inspection, assessment, examination, or other consideration required for the purposes of issuing a compliance certificate under any of the following regulations of the Health and Safety at Work (Hazardous Substances) Regulations 2017.
These regulations are: 6.23; 10.34; 10.36; 12.17; 12.42; 13.38; 15.16; 15.37; 15.66; 16.34; 16.36; 17.91; Schedule 1, clause 45.
Authorised to issue certificates for
Approved Filler (Gas Cylinders)
Approved fillers of gas cylinders [Regulation 15.66, Health and Safety at Work (Hazardous Substances) Regulations 2017]
Conditions: The certification of approved fillers is limited to fillers charging cylinders with class 2.1.1 substances (Liquefied Petroleum Gas and Ammonia) only.
Class 6

Conditions: The certification of handlers (class 6) does not include agrichemicals.

Fumigants

Conditions: The certification of handlers (fumigants) is limited to:
- aluminium phosphide,
- chloropicrin,
- dichloropropene,
- dichloropropene & chloropicrin,
- ethanedinitrile (EDN),
- formalin,
- hydrocyanic acid,
- methyl bromide,
- methyl iodide,
- magnesium phosphide and
- phosphine.
The certification of handlers of ethanedinitrile (EDN) is for the life cycles use, storage, transport and disposal.
The certification of handlers for all other fumigants listed above is for the life cycles disposal, manufacture, storage, transport and use.

Installation

Conditions: The authorisation for stationary container systems is limited to above ground tanks up to maximum capacity of 45,000,000 L per tank used or intended to be used to contain a class 3.1 hazardous liquid; or 5,000,000 L (water capacity) per tank used or intended to be used to contain hazardous liquid; or 225,000 L (water capacity) per tank used or intended to be used to contain a class 2.1.1 substance.
The authorisation for stationary container systems is limited to below ground tanks with a maximum capacity of 100,000 L (aggregate total) per tank used or intended to be used to contain a hazardous liquid.
The authorisation for stationary container systems does not include a design that is to be certified as per regulation 17.93(1)(a) [Health and Safety at Work (Hazardous Substances) Regulations 2017].
The authorisation of stationary container systems does not include a fabricator for the purpose of constructing a stationary tank or process container in accordance with a design as per regulation 17.93(1)(b) [Health and Safety at Work (Hazardous Substances) Regulations 2017].

Conditions that apply for this authorisation
Ms Stockdale must perform the functions of a compliance certifier in an objective manner that promotes safety.
Ms Stockdale must remain a fit and proper person throughout the period of her authorisation.
Ms Dianne Stockdale must not use any third party in any capacity in respect of the inquiry, inspection, assessment, examination, or other consideration required for the purposes of issuing a compliance certificate under any of the following regulations of the Health and Safety at Work (Hazardous Substances) Regulations 2017.
These regulations are: 6.23; 10.34; 10.36; 12.17; 12.42; 13.38; 15.16; 15.37; 15.66; 16.34; 16.36; 17.91; Schedule 1, clause 45.
Mrs Stockdale must not certify hazardous substance locations or stationary container systems for classes 2, 3, 4, 5, 6 and 8 substances at a facility that is designated by WorkSafe as a lower tier major hazard facility or an upper tier major hazard facility under regulation 19 or 20 of the Health and Safety at Work (Major Hazard Facilities) Regulations 2016.
