Ms Stockdale was suspended on 7 February 2020 for all categories, while subject to an investigation into her performance as a compliance certifier. This suspension was lifted on 18 February 2020. The investigation was concluded on 9 September 2020.

Under regulation 6.20(1)(b) of the Health and Safety at Work (Hazardous Substances) Regulations 2017, Ms Dianne Stockdale's authorisation as a compliance certifier for the issuance of certified handler compliance certificates under regulations 4.1, 6.23, 13.9 and 14.3 was suspended with effect from 14 October 2019 on the grounds that Ms Stockdale has failed to perform the functions of a compliance certifier in an objective manner that promotes safety. This suspension was lifted on 11 September 2020.

Ms Dianne Stockdale’s authorisation as a compliance certifier was varied with effect from 14 October 2019 under regulation 6.20(1)(c) of the Health and Safety at Work (Hazardous Substances) Regulations 2017 on the grounds that Ms Stockdale has failed to perform the functions of a compliance certifier in an objective manner that promotes safety by not adequately supervising or assessing the work of third parties that she engaged.

This variation added the following condition to Ms Stockdale’s authorisation:
Ms Dianne Stockdale must not use any third party in any capacity in respect of the inquiry, inspection, assessment, examination, or other consideration required for the purposes of issuing a compliance certificate under any of the following regulations of the Health and Safety at Work (Hazardous Substances) Regulations 2017.
These regulations are: 6.23; 10.34; 10.36; 12.17; 12.42; 13.38; 15.16; 15.37; 15.66; 16.34; 16.36; 17.91; Schedule 1, clause 45.

The authorisation for stationary container systems does not include a design that is to be certified as per regulation 17.93(1)(a) [Health and Safety at Work (Hazardous Substances) Regulations 2017].

The authorisation of stationary container systems does not include a fabricator for the purpose of constructing a stationary tank or process container in accordance with a design as per regulation 17.93(1)(b) [Health and Safety at Work (Hazardous Substances) Regulations 2017].

  • Ms Stockdale must perform the functions of a compliance certifier in an objective manner that promotes safety.
  • Ms Stockdale must remain a fit and proper person throughout the period of her authorisation.
  • Ms Dianne Stockdale must not use any third party in any capacity in respect of the inquiry, inspection, assessment, examination, or other consideration required for the purposes of issuing a compliance certificate under any of the following regulations of the Health and Safety at Work (Hazardous Substances) Regulations 2017.
